TERMS OF SERVICE

All tenants and authorized drivers, designated by AIRCAR on the front of this contract, must be at least 19 years old (including 1 year of valid driving license), provide their identity card (or valid passport) in addition to being a credit card holder. The rental is granted for a firm period specified on the front of this contract. The rental day corresponds to 24 hours, from the time the car is picked up.

Every day started is due. AIRCAR reserves the full right to end the rental and recover the vehicle by any means without justification or compensation in the event that the tenant has not respected one of the obligations of this contract incumbent on him or if a problem occurs in payment: rejection of the check, refusal of the credit card, exceeding the number of rental days authorized by this contract. In any case, the customer must have paid the entire rental period before picking up the vehicle.
Upon delivery of the vehicle, the renter and approved drivers become fully responsible to AIRCAR for the full execution of these conditions.

MECHANICAL :

Normal mechanical wear is the responsibility of AIRCAR. All repairs resulting from abnormal wear, negligence on the part of the customer or an accidental cause will be the responsibility of the customer. Defective parts replaced must be presented with the regularly paid invoice stating the full amount of the repair.

TYRES:

The lessee declares that the five tires of the car are in good condition, without cuts; that wear and tear is normal. In the event of deterioration of one of them for a cause other than normal wear and tear, the renter undertakes to immediately replace it with a tire of the same size and brand as those fitted to the rented vehicle.

VEHICLE CONDITION:

The tenant will not be able to claim damages from AIRCAR, either for late delivery of the car or cancellation of the rental, or for necessary repairs due to normal wear and tear carried out during the rental, AIRCAR disclaims all liability for illegal uses of cars by tenants. Optional guarantee and additional insurance: the tenant is guaranteed according to the general conditions of the insurance policies contracted by AIRCAR, namely: accidents caused to third parties according to the deductible and civil liability, for fire and theft of accessories, clothing and all objects inside the car and the trunk, the driver remains his own insurer, the customer must return the duly completed police or gendarmerie report and, failing that, cover all sums for repair of the vehicle within the limit of the excess, the customer must in no case discuss responsibility for the accident, nor compromise with third parties or take any action that could hinder or commit the insurance company in settling the claim, the tenant remains responsible for the damage caused to the lower parts of the vehicle for any reason whatsoever, even if he has subscribed to the redemption of the CDW excess.

The lower parts meaning the organs located under the frames:

  • Damage inside the vehicle.
  • Damage caused to tires and rims.
  • Radiator, cardan shaft,… which are not covered by the insurer.

The tenant is also responsible for damage caused to the windshield, or any other broken glass or signal lights. Finally, the tenant is forfeited from theft, fire and damage caused to the vehicle guarantees, any driver in a state of intoxication or under the influence of an alcoholic state or under the effect of drugs or any other substance modifying the reflexes essential to the driving.

EXTENSION DEPOSIT:

The tenant will pay in advance, the deposit deposited by him cannot under any circumstances be used to extend the rental by accompanying it with a corresponding provision, under penalty of exposing him to legal proceedings for misappropriation of vehicle and breach of trust .
However, the lessor reserves the right to refuse the extension of the rental, with the obligation for the latter to immediately return the vehicle.

THEFT INSURANCE:

The tenant is insured against theft, but this guarantee can only be applied subject to the return of the keys, the vehicle registration document and other documents necessary for circulation, as well as a theft declaration completed by the police or the police station. The excess remains the responsibility of the customer.

RETURN OF THE VEHICLE:

The vehicle must be returned during the opening hours of the rental agencies, on the date, time and place stipulated in the contract.
The vehicle must also be returned with the documents, equipment and accessories for circulation.
If the tenant cannot return the circulation documents or the vehicle keys, he remains liable to AIRCAR for the days of immobilization until he produces a certificate of loss as well as the costs of issuing the duplicate.

FINES AND INFRACTIONS:

The tenant and/or approved drivers are responsible for fines, tickets and citations issued against them. He undertakes to reimburse the amount to AIRCAR if the latter were required to advance it.

JURISDICTION:

In the event of a dispute which may arise from the execution of this contract, the courts of Casablanca will have sole jurisdiction.

CONFIDENTIALITY AND DATA PROTECTION:

Aircar is the data controller who operates the site www.aircar.ma, the information requested from you is necessary to process your order and is treated confidentially. You have the right to rectification relating to data concerning you.
